What Federal/State Act must you rely on to guide you through this process?
As a Director of the Electronic Record Delivery Program, I would rely on the Privacy and Security Rules and Regulations of the Health Insurance Portability and Accountability Act (HIPAA) .2. What does this Act say about the use of electronic medical information?
The Privacy and Security Rule primarily protects the patient’s medical records from exploitation and accessibility by the patients themselves. Through this act, the only person who can access, aside from the authorized personnel in a clinical organization, is the patient. He or she can request for a copy of their medical records and assess the usage, access and sharing of their health records. This act also requires a health organization to provide security measures to protect any form of information stored electronically. Any electronic health record should have access security controls such as PIN and passwords as indicated in the Privacy and Security Rule .3. What legal options does the patient have as it pertains to this case?
In this case, the patient has the right to file a complaint against unlawful access, breaches and possible theft of secured health information. Such case is an obvious violation of the Privacy and Security Rule of the HIPAA. It is also possible that there is a cause for medical negligence on the part of Pierce Hospital as there are no or vulnerable security protection among its laptops and computer equipment .
4. If the program does survive, what can you do as director to ensure that something like this does not happen again?
As a Director, I seek for endorsement of a policy and standards in terms of protecting the computer equipment and network infrastructure within the hospital. With the help of my team, I will conduct a mandatory training and seminar with regard to the laws with regard to privacy and security of medical information as well as its implication if violated. I will also seek the support of the management to invest on security software and tools and equipment to guard any form of information within the hospital 24 by 7.
