RE: RESPONSE TO DEMAND FOR REFUND
I write in response to your letter dated 1st March 2015 where you requested for a refund of part of the money you had paid to the company for supplying you with building materials. I would like to inform you that while we are greatly concerned about the issues you raised in the letter, the company does not have policies that would support a refund of payment in such circumstances as you explained in your letter.
In the said letter, you indicated that you would be interested in getting a refund from my company following transaction No. 221/15. The transaction above arose from a contractual relationship that came to exist between my company and you and me on 15th January 2015. Under the contract, our obligation was to provide you with building materials whose value were clearly stated in the contract itself whereupon you would pay a total of £ 25,000, which you did on receipt of the materials. In requesting for a refund, you explained that about 10% of the materials supplied by us had been damaged during transportation.
It is our culture at Buildtex to offer the customers the best of our services. Nevertheless, we do receive complaints of your nature every now and then. What we do advice our customers in such instances is that we are always willing to accept liability in the event that damage to goods occur while they are still in our hands. The moment the customer collects the goods, all liability is transferred to them. The company then ceases to be liable for any damage to the goods. Where damage to goods occurs after they are collected by the customer, they are usually advised to meet the costs of the damages suffered.
