a) According to the agreement between the four friends and Elie, Hasia did not exist. As a result, Hasia was not among within the terms of the contract. Although Ellie had promised him one-fifth of any winnings, she is entitled to give Hasia part of her share but not that of their group. Ideally, this amounts to a third party beneficiary of a contract. Contract law can be expressed implying it can be in writing or implied that is, it can be orally stated. In this context, the contract between the four friends and Ellie is implied.
b) Abbi’s failure to buy tickets as per agreement amounts to breach contract under the stands of repudiation. The law of contract entails that once a contact is accepted it cannot be revoked. Abbi entered a contract and thus failed to deliver as per agreement something that amounts to breach a contract. As a result, Abbi is liable for any damage to the other members in the contract.
c) The terms of the contract look like the contract is agreements to agree. In such a case, this may not amount to a valid contract. However, Bemo’s failure to honour the agreement may amount to inferior performance, which entails failure to perform as per implied or express obligations. The use of email to revoke the agreement does not void and in that case, Bemo is deemed to offer the services as per agreement.

However, in situations whereby the terms are not clear, then the contract may remain with respect to what the parties in the contract agree. Ideally, this means that the members need to respect and honour the terms of contract without any failure. The case in hand involves a traditional offer and its legal viability depends on the terms of the contract as well as the per the parties agreement.
