Free Crime: Robbery Essay Sample
In violation of Florida State Statute: §812.13-812-135
Initial Report:
On 22 March 2015, at about 2100 hours the undersigned entered Room No. 213 of the Citadel Apartments located at 321 Forest Glen Road in response to an emergency dispatcher’s call. There was no response to a knock on the door and the door was not bolted from the inside. An elderly couple, later identified as Mr. Eugene Harris, 72 years of age, and his wife Linda Harris, 71 years of age were found hogtied to the bed post and their mouths covered with duct tape. After searching the apartment carefully and determining that no other persons were inside the apartment, the couple was freed and the duct tape removed from their mouths.
The couple reported that a man knocked at their door at around 2000 hours and claimed that he had a parcel for them from their old friends in Ohio. They described him as about 5’9 tall, Caucasian, with brown hair and brown eyes, and sporting a mustache. He was dressed in a long sleeved plaid shirt rolled halfway up his arms and looked decent enough. He was carrying a plastic bag, which seemed to contain a box from what they could see. He said his name was Anthony Brown. Mr. and Mrs. Harris originally came from the state of Ohio and had relatives and friends in that area and were excited to hear anything about them. They immediately allowed the man in to the apartment. He asked for a glass of water after which he opened the bag he carried and drew out a gun concealed in the box inside it. He demanded that they hand over all their money to him all the time pointing the gun at them and threatening to shoot them if they do not.
Earlier in the day, Mr. and Mrs. Harris went to the Wells Fargo Bank along E Bay Drive to withdraw $10,000 from their savings account because they planned to take a trip to Hawaii later in the week. They intended to buy the tickets the following day. The money was in Mrs. Harris’ bag, which was placed atop a bedside table. When the man pushed them to the bedroom, he saw the bag, opened it and saw the money. He took the money, hogtied them to the bed and duct taped their mouths.
Supplemental Report:
After an examination of the CCTV cameras located within the vicinity of the apartment where the crime happened, the CCTV camera of the dry cleaning shop located across the apartment showed a man walking the street and entering the Citadel Apartments at exactly 2038 hours on 22 March 2015. He was dressed in a plaid polo shirt with sleeves rolled up to below the elbows and matched the descriptions given by the victims. He was carrying a brown plastic bag, and after 10 minutes, the man came out of the apartment and walked towards the opposite direction.
Investigative Report:
The man’s face as captured in the CCTV camera across the apartment building where the crime happened was matched with local and FBI databases. A match of the man’s facial and body built description was found in the local police database, which identified him as Kevin Ham of No. 6852 Kepp Drive, 28 years old, presently unemployed after he was discharged from his employment a month ago for insubordination. Kevin Ham has police record for DUI. A close investigation revealed that Ham lives in the apartment together with his cousin Luke Ham, who works at the Wells Fargo Drive in E Bay Drive. After questioning both persons, it was revealed that Luke and Kevin conspired to rob the victims of their money with Luke providing the necessary information and Kevin conducting the actual robbery.
Probable Cause Statement:
Kevin Ham, in conspiracy with Luke Ham, committed robbery by taking the money of Mr. and Mrs. Harris in the amount of $10,000, without the latter’s consent and by using threat, intimidation and physical force. After given the information that the couple had just withdrawn money from the bank, Ham planned to rob the couple of their money by using false pretenses to enter their apartment showing specific intent to take the money and deprive the couple of it.
