E-commerce is a relatively new business model that refers to the use of electronic means and technological advances to conduct commercial transactions within a business, business-to-business and business-to-customer. It is the use of electronic networks that brings up the matters of commercial advantages and legal concerns.
Before the selection of a country for establishing an e-commerce business, factors such as the Internet infrastructure, a legal framework, consumer protection and data protection should remain paramount. Internet infrastructures are systems for transfer of information including communication networks, which are vital in e-commerce.
A country with proper internet infrastructure is important as it provides a transmission line for e-commerce through the wide network therefore allowing extensive operations and service to many customers who can access the internet. A country with a proper legal framework will maintain a regular operation of e-commerce. Without laws, any e-commerce system is only an empty promise (Qin, 2009). The e-commerce law is meant to establish authentication which is vital in e-commerce. The laws of the country should be able to address the security concerns of internet business including e-commerce transactions where privacy of the enterprise covers the product price, purchasing channels and promotions among others. Also, the legal framework will address the contracts involved in e-commerce. Consumer protection enhances to a great extent the healthy development of e-commerce. The country in question should have effective consumer protection laws and initiatives to prevent illegalities such as a false trade, counterfeit products and price pushing to make the commercial environment conducive for both the consumers and the enterprises. That will also address the matters of consumer privacy.
Trading blocs including the EU, ASEAN and the Mercosur, present a significant potential for e-commerce. The regions have a history of acknowledging the importance of consumer protection and launched directives to that effect. Similarly, the regions adopted a liberalization of telecommunication services by enhancing online access to decrease costs by competition. Finally, the regions enacted in succession many regulations concerned with e-commerce including the tailored E-Commerce Law aimed at speeding up development and operations of e-commerce in the regions.
