Introduction to Contracts

I agree with the decision of the court in the case of Lambert v. Barron, when the court ruled that there was no contract that existed between Lambert and Barron. Since the two are good friends, Lambert is only considered to merely help Barron to resolve some financial troubles and legal issues. Lambert expected to be paid for his consultancy services. He further claimed that he and Barron entered an oral contract, wherein the latter agreed to pay him a monthly rate of $3,100 dollars for consultancy services. Although Barron initially paid for one invoice, he refused to pay the second invoice claiming that no contract existed between them. As a result, Lambert sued Barron for breach of contract.
The ruling of the court in denying Lambert of his claim for damages for breach of contract is correct. There was no contract entered between the parties. For a contract to be considered legally valid and binding for all its intents and purposes, three elements should be present: consent, object of the contract and price or consideration (Miller 133). The first element to test whether a contract was perfected is to determine whether the parties had the intention to legally bind themselves to the contract. The second test is to see whether Lambert and Barron reached a reasonable agreement to perform their obligations and the price or consideration for the promises made.
In this given case, it was shown that Lambert and Barron had a friendly and professional relationship. Thus, the act of Lambert in helping his friend to resolve his financial trouble does not mean that Barron agreed to pay him for consultancy services since the friendly advice given by Lambert was not supported by a contract. Therefore, there was no valid contract between the parties.
