Antitrust laws prohibit unlawful mergers and business practices, and the court is left to decide which are illegal based on the facts of each case. In the last century, antitrust laws have had the objective of protecting the process of competition. It is done for the benefit of consumers making sure there exist strong incentives for a business to operate efficiently, keep the quality up and the prices down.
FedEx Corporation is attempting to acquire TNT Express. In my opinion, this deal may be successful especially based on the antitrust laws and their objective of protecting the competition in the industry. Two year ago European regulators blocked a bid for TNT claiming they were concerned that it would decrease competition and increase prices. FedEx’s deal is more likely to go through since it only creates more competition with DHL and UPS, which control almost two-thirds of the European express delivery market. Also, unlike the previous UPS transaction, FedEx’s deal has less overlap between the two companies. TNT has also agreed to comply with the European Commission policies. It has agreed to sell its airline operations since the Commission restricts foreign ownership of airlines.
Environmental Regulation
The state of Arizona has strict environmental laws. The laws are on various issues including light, water, soil, hazardous waste disposal, solid waste, air quality among others. Based on the State’s environmental laws, there should be no gas storage facility that should be located in a county with a population of more than a million five hundred thousand people. It is also required that all outdoor fixtures are partially or fully shielded except incandescent fixtures with one hundred and fifty watts. The state also requires that a check is done on where excavated soils are to be deposited. The owner of the property where the soil is to be deposited is required to file a written notice. The state has control of rights and violations related to petroleum refineries, air pollution by portable sources; coal-fired stations and smelting of metal ore. All industries and organizations are required to apply the best management practices to maintain quality water standards. The practices involve methods, practices or measures to prevent and reduce discharges. They include operation and maintenance procedures, nonstructural and structural controls. The practices can be applied before or after discharges in order to reduce or eliminate the introduction of pollutants into the receiving waters. The law also has clean closure requirements. Industries and all organizations are required to reduce the probability of further harmful discharge especially those that exceed water quality standards.
Being a business owner in this state, I would purpose to adhere to the rules and regulations set by the state government. The state has huge penalties for individuals or organizations that violate these laws. I intend to ensure my company policies are set in line with the environmental rules and regulations of the state. The company will also ensure that employees are aware of the state’s regulatory requirements and that they comply with them. Employees will be made aware of these regulations through training sessions and other environmental awareness programs. The company also intends to participate and carry out programs to educate the community on the need to obey these regulations and protect the environment for future generations. It is important that everyone in the state understand the environmental laws and regulations. The burden of fulfilling these regulations should not only be left to industries and organizations, but also the society.
