Differences between Federal and Common Law Practices
Federal laws are laws that are developed by federal governments of a country. The laws are passed for the mutual of the citizens to help deal with challenging issues and to make existing laws formal. Federal laws fall under written law because they are passed by the legislature. It is easy to implement them because they are written down and only require application in a specific case. Federal laws are applied in areas under their jurisdiction and areas where the common law is not applicable (Scheb and John 13).
Common law also known as case laws are based on past rulings of judges. If there is no past ruling that is applicable, the jury has to make a ruling that automatically becomes law. In common law, the decisions of the higher courts rule over those of lower courts and precedent cases (Worthington 62). Common law is come about evenly since a ruling could be used to make forthcoming judgments of the same nature.
National Labor Relations Act
The National Labor Relations Board is an organization in the United States. It is composed of five members selected by the president but with the knowledge of the Senate. Chairman of the Board is one of the members. It is composed of a General Counsel, who is chosen by the president. His role will be to supervise all the attorneys of the Board, and workforces hired in regional offices (National Labor Relations Board 940).
Employees have a right to join labor organizations according to the National Labor Relations Act. An employee has no authority to interfere with the formation of a labor movement or even put conditions that might either encourage or discourage an employee to join such an organization. Moreover, it is unlawful to discriminate against an employee because he has pressed charges under the Act.
