Although litigation has been relatively low at this point, it is anticipated numerous cases will arise over the extraction of natural gas, such as through fracking
How Regulations Are Selected and How This Law is Enforced Through an Acquisition Agreement
How is the law selected?
Does the chosen law repair or answer common commercial inquiries in a normative fashion?
Does the law select protect the parties, rights, obligations and risks?
How are the contracts analyzed and judged?
Civil and common law systems in agreements together
Commercial terms that are ambiguous
Problems of applicable law that may supersede the contractual regulations
Arbitration
How will these laws and agreements be enforced? Which jurisdiction?
Other Major Challenges
Determining the exact amounts each nation is exporting, importing and producing is exceptionally difficult due to the network of pipelines for transmission. This is especially true in the case of liquid natural gas
How much is reserve? This must be accurate to ascertain the true value and its impact on a nation’s overall wealth for investment purposes
How will this gas be extracted? With the environment being of primary concern, techniques such as flaring and venting need to be examined to illustrate how they affect the environment and if they are being used
Evening out the supply and demand of natural gas so the prices are not too high or too low
Countries need to know exactly how much it costs to transport natural gas and that is remains nebulous
Ensuring statistical data from each country on natural gas remains confidential when necessary and accessible when it is required for it to be so
