Yes, Jim Arbor has an employment contract. A contract between an employer and a worker has certain features that both of them should be familiar with and in this situation one important clause, is the non-compete clauses that is restricting Mr. Arbor from practicing his skills to business rivals after leaving Mr. Discrimina’s company. However, Mr. Arbor should ask his employer to put profit sharing and salary increases in writing. This is crucial because all clauses in a contract should be put in writing and presented to the attorneys of both parties represented, so that in any case one party breaches the contract, he or she should be pay or face the law. Jim Arbor should insist for a salary increase to be in writing because his employer is likely not to honor their agreement. This is evident because Mr. Discrimina is threatening to lay him off if he does not sign the confidentiality agreement indicating that he is a man is only after fulfilling his selfish interest. Another reason to determine that Mr. Discrimina is a person who will not follow the contract is the fact that he takes advantage of the personal relationship between Jim and Eunice and uses her to coax him so that he can accept the terms in the contract. This is wrong for any employer because there are ethics that should govern the relationship between an employer and an employee.
It’s not fair for Eunice to take advantage of the fact that Jim does not realize the importance of his services and inventions because there are federal laws protecting individuals from employees who withhold crucial information and this is likely to land her in trouble if Jim finds out and takes her to court. It is not right for her to convince Jim because, based on their personal relationship, he is likely to give in fast so as to try to maintain their relationship. An independent person should be used so as to enable Jim to make an informed decision.
