Good Research Paper About Minors Should Not Be Tried As Adults

Minors or individual that have not attained legal age have every right to be tried differently from their adult counterparts. It is this fact that led many constitutions globally incorporate juvenile courts due to studies that have pointed out differing mental capabilities between adults and children (Dunlap, 2004). Much of the juvenile delinquents can easily be managed through systems tailor-made for them such as child-centric guidance and counseling, and sentences.
The disadvantage of trying minors as adults lies in the fact that most minors are treated differently in various areas of law. Myers (2005) notes that minors do not enjoy the same privileges and responsibilities as adults. This ideally shows that the law appreciates the facts that minors and adults have their inherent differences when it comes to decision-making. It is thus, important for the society to understand that it is not in the legal spirit to subject children to adult processes.
The next disadvantage is established in the fact that studies show that moving a minor from a juvenile court to a criminal or civil court increases crime and does not reduce reoffending. It is prudent to note that children need a unique approach when it comes to redemption and reform (Hile, 2003). Moreover, juvenile correctional facilities are well equipped to manage the reformation process as compared to adult prisons.
In conclusion, the management of minors when it comes to reformation should be handled differently from adults’. This facts are based on the disadvantages that emanate associated with trying minors as adults as aforementioned. The first disadvantage is enhanced by the fact that the Constitution affords minors and adults different treatment. The next disadvantage is established through studies that indicate putting minors through the adult reformation systems only helps in enhancing crime.
