Legal responsibility to offer medical cover
Previously, there was no law that required the employers to pay for their workers health related expenses. Currently, in cases where the employer decided to provide health- related benefits to employees, they must ensure that they comply with several laws of Federal anti-discrimination legislation and health plan regulations because there are acts that have been passed by the parliament that provide guidelines on how employers should provide health insurance to employees. Discrimina incs has a legal responsibility to enroll all the employees in Employee Retirement Income Security Act and the Act covers for pensions and health insurance. Additionally, Discrimina Inc has a legal responsibility of ensuring that they uphold the Affordable Care Act because through the Act; workers benefit from the health insurance even after they are fired (Patel & Rushefsky 2014).
Legal options that Frank Oldburr have to get himself covered with a health plan
There exists a health care law that criminalizes any insurance company’s actions that cancel the coverage of a worker when they get sick. Previously, there were no rigid laws to protect workers from employees who do not consider their health needs. Today, even in a situation where some crucial information is left out, or a mistake is done while filling in the forms. Insurance companies are supposed to inform the client on cancellation of the cover thirty days before the cancellation (Smith et.al 2013). If Frank Oldburr seeks a legal redress the process will be reversed and his medical cover reinstated and his medical bill fully paid by the insurance company.
Ways to come to a win-win situation and an Explanation
Yes. A win-win situation can be possible if the employer gets a good insurance company that charges lower premiums but when employees are sick they are accorded the best health care. Additionally, if Frank sues the employer, due to his old age he may end up benefiting from retirement pensions and his health care expenses catered for by the insurance company. If such a situation occurs, it shall be a win-win situation.
