Intellectual Property Laws

The intellectual property laws are put forward with one major purpose of protecting individuals or organizations on their intellectual property which refers to their own creation i.e. creation of their mind. Intellectual properties vary and as such they may include discoveries and inventions, music, designs, literature and other artistic work, phrases, symbols, and products. As such, several intellectual property rights have been created to ensure that once creation is safe and they maximally benefit from it. Some of the laws include patents, copyright, rights protecting trademarks, industrial design rights, and trade secrets.
The intellectual property policy is for the organization i.e. to protect its findings and products from being copied by other organizations without them having paid for whatever action they may take in regards to the findings made . The policy is of benefit to the organization as it ensures that any use of their finding or making of whatever belongs to them is duly paid for. As stated earlier, intellectual laws such as patents, trademarks, copyrights, and ownership of company material and these are discussed below.

A patent is a form of intellectual property that is inclusive of a set of rights that are exclusively granted by the state to an individual or organization that makes discovery of something new i.e. invention for a specified period of time in exchange of an informed disclosure of whatever has been invented. The rights that are granted by the patent include the prevention of other individuals making, selling, using, importing, and distributing an invention that has been patented without permission.

Trademark

A trade mark is a form of intellectual property law which is a recognizable design or sign or even expression that is used as an identity of an organizations products and services from those of other organizations. The owner of the trade mark may either be a specific person, legal entity or business organization. The trade mark may be placed on a label, package, the product itself or on a voucher. In addition to these, organizations may also place trademarks their buildings as corporate identity.
This is a more advanced intellectual property law which is developed by a country in order to grant the person who has created something exclusive rights towards its distribution and use and it is usually over a limited time so as to enable the one who has created it to get compensation for their intellectual effort. These rights usually are inclusive of distribution, reproduction, public performance, control over derivative works as well as moral rights for example attribution.
When one’s intellectual properties have been infringed, one may opt to report it and they may do so in eBay which developed Verified Rights Owner (VeRO) which is a program that was put in place with the main purpose of helping in the protection of intellectual property as well as the consumer . One may report this by downloading a Notice of Claimed Infringement (NOCI) and submitting the form to eBay’s designated agent.
In conclusion, intellectual property laws are of great importance to individuals as well as organizations. It is therefore of great essence for those having intellectual properties to make sure they obtain an intellectual property right so as they can protect their inventions from being copied or from others claiming that they are the ones who have come with the inventions. As such, intellectual property laws are meant to duly protect inventors and their inventions.
