Human resource management is an act of overseeing the hiring, recruitment, and retention of workers in a company. It is the duty of the human resource department to protect all employees and those seeking employment from discrimination of any kind. Although all human resource managers are accountable for acting within the limits of the corporate policy and law, they have to adhere to them for the organization to be in existence. The aim of this study is to discuss how legal factor affects the human resource management in the hospitality industry especially during recruitment.
The disability act had made it tranquil for an individual to show that they are physically challenged and safeguarded from disability discrimination. In the Act, an individual is disabled if they possess mental or physical impairment which has long term and substantial adverse outcome on their ability to conduct daily activities like reading a book, using a phone or using public transport. The own should make the necessary adjustments when recruiting, selecting, initiating and endorsing disabled workers (Cole and Smith 56). This Act lays a duty to the manager to make the necessary adjustments for the staff to assist them in overcoming their disadvantage subsequent from an impairment. For instance, they can give assistive technologies to assist the visually challenged to use computers effectively (Pollitt 34).
The Equality Act safeguards individuals from being discriminated with their religion. The Act protected individuals from all any discrimination of any religion. Jobseekers or employees are protected by this law if they follow a particular religion or none whatsoever. In addition, a religion has to have a clear belief system and structure. Belief includes any philosophical or religious belief inclusive of no belief. In order to be protected from this discrimination, the belief has to fulfil several criteria including that it is a substantial and weighty aspect of human behavior and life.
Another legislation that may be passed by the government and affect the recruitment process in the hospitality industry is alterations to the wage law. If the wage increases, more and more workers go into the market giving way for the business to select highly skilled employees. It improves the opportunity for the small business owner to increase productivity by the use of better-skilled employees who were not available previously. In order to increase wages, some small business owners may choose to increase the wages of the workers by reducing the number of employees a solution that has advantages and disadvantages on the recruitment process. On one hand, a good pay might encourage the highly skilled employees and improve productivity. On the other hand, workers who are overworked are susceptible to numerous absenteeism, terrible customer service, underperformance and diminished productivity.
Another way through which recruitment is affected is during advertisement. When one is advertising for an opening of a job, one should not discriminate on grounds of sex, race or age. By saying you want a keen young employee that would be termed as age discrimination. Discriminating one ground race happens when an individual is treated less favorably on the grounds of race. Discriminating by race does not necessarily involve the color, it also includes religion, national origin or citizenship (Larry 22). The law also protects the physically disabled from discrimination. Therefore, the law influences how the recruitment process takes place in any organization.
In conclusion, the human resource managers have to stay in updated with information that alters the roles and responsibilities of employees. It involves staying updated with the employment law, workplace discrimination and harassment laws too. It will prevent the organization from being caught off-guard if the laws are altered.
